1 – ACCESSIBILITY

To make a reservation, you must be a natural person aged at least 18, recognized and in good standing under the laws of the country in which you are established, and have the capacity to contract.

You agree to provide complete and accurate information.

By booking on behalf of other participants, you are presumed to be the contact person designated for each participant appearing on this reservation. This means that you are responsible for making all payments due in connection with your reservation, informing if there are changes or cancellations are necessary and keeping your group informed. By reserving on behalf of one or more other persons, you declare and guarantee that you have obtained all the required consents.

The user must be able to contract and use this website in accordance with these Terms of Sales in force on the date of validation of his purchase. Your participation in the service constitutes your acceptance of the general conditions described here. The participation who is under the age of 18 in the services is authorized if a parent or legal guardian (adult) also accompanies and participates in the service, and has also read and consented to this policy.



2 – MODIFICATIONS OF THESE CONDITIONS

These Terms of Sales are also available in French. They can be consulted at any time from the website www.background.paris. They must have been accepted without reservation to finalize the purchase of the services.

By purchasing a service on the site www.background.paris, the user expressly acknowledges having obtained all the information necessary for his informed consent as to the nature and characteristics of the service chosen.

Acceptance of the Terms of Sales implies consent and acceptance of the processing of personal data.

Background Paris reserves the right to modify these conditions at any time in accordance with this article. If we modify these conditions, we will publish the modified conditions on the site www.background.paris by modifying the date “Last update” appearing at the top of the conditions.

The user has the option of keeping the Terms of Sales by saving or editing them, using the standard functionalities of his browser or his computer. This conservation is exercised under its responsibility.

The version of the Terms of Sales opposable to the user is that appearing on the site at the time of the final confirmation by the user of his purchase request.



3 – SPECIAL CONDITIONS FOR THE PARTICIPANT

The user’s attention is expressly drawn to the importance of verifying the accuracy of all the information entered and correcting it if necessary, according to the terms offered on the site before any final confirmation.

Any inaccurate or erroneous information from the user may justify the non-execution of the purchase without Background Paris being able to see its responsibility engaged.

The user therefore guarantees Background Paris against any action or claim by third parties regarding the illicit or fraudulent use of their data in the context of the use of the service.

By reserving our services, you accept that Background Paris assumes no responsibility for any loss, injury or damage to a person or property, or otherwise any link with any transport, or other services, resulting directly or indirectly from any act of co-travelers, suppliers, nature or dangers, delays, cancellations, and incidents related to weather conditions, health problems before, after or during the trip, allergies, fire, acts of the government or other authorities, de jure or de facto, war, civil unrest, terrorist attacks, strikes, riots, theft, epidemics, quarantine, medical or customs regulations, defects, delays or cancellations or changes in schedules, or any cause beyond the control of Background Paris.



4 – PRICES – FINANCIAL CONDITIONS

The prices of the services sold are those in force on the day the order is taken. They are denominated in euros and calculated without taxes. As a micro-enterprise, and according to article 293 B of the CGI, the prices are exclusive of VAT, free of VAT.

Background Paris reserves the right to modify the price of the services offered at any time, but undertakes to apply the prices in force when the order was registered.

Any promotional offers are only valid for the period of validity of the offer concerned. Current promotions cannot be combined with each other. They cannot be exchanged for their monetary value or be reimbursed in part or in full. After the deadline indicated, the reduction will be permanently lost. Credits generated during the transformation of a gift card or in case of cancellation are not refundable.

Similarly, the non-consumption of a gift card or a prepaid service cannot give rise to any refund. You acknowledge that you agree to pay the full price and the charges relating to the subscribed service. You acknowledge that you are solely responsible for the effective payment of the subscribed service.

These prices are updated on the site as and when changes are made.

No discount will be granted in the event of early payment.



5 – INFORMATION ON SERVICES

The following information is sent to the user before purchasing: a description of the essential characteristics of the service (date of service, time, duration, location, maximum number of participants, price, duration of validity of the service ordered).

The tickets that can be ordered on the site are generally subject to a specific validity period, that is to say exclusively on the day of the service.

The number of visitors per experience is defined for each one, with a maximum number of customers.

The photos presented on the site have no contractual character.



6 – RESERVATION TERMS

Subject to compliance with all the conditions defined by Background Paris, you can book a service offered on the site www.background.paris by following the appropriate booking procedure.

The user booking procedure goes through the following steps:

Step 1: Selection of the date chosen on the “Booking” calendar.

Step 2: Selection by the user of the desired service after becoming aware of its essential characteristics as described on the site (services section). There are three services: experience, workshop, visit.

Step 3: The user must enter his personal data such as his last name, first name and email address.

Step 4: Confirmation by the user of the information appearing on the summary displayed on the site recalling the selected service, the total price of the service, the number of participants and, the information entered by the user. The latter can always at this stage identify any error and correct it according to the terms and conditions appearing on the site or, modify his reservation according to his convenience or even abandon it altogether; Before confirming the order, you can at any time correct any errors made in entering your data.

Step 5: Unreserved acceptance of these Terms of Sales and acceptance of the processing of personal data.

Step 6: Final confirmation by payment by credit card.

Step 7: The user will access an order confirmation and thank you page.

Step 8: The user will receive a confirmation by email of the registration of his reservation, his electronic ticket with the necessary practical information and his relative invoice.

Upon receipt of a booking confirmation, a legally binding agreement is established between the user and Background Paris.

If you book a service on behalf of additional participants, you must verify that each of them respects the conditions defined by Background Paris, and is informed of these conditions and accepts them.

If you make a reservation for an additional traveler who is a minor, you declare and guarantee that you are legally authorized to act on behalf of the minor. In order to participate in a service, minors must be accompanied by an adult who is responsible for him.

You must carefully read the description of any service that you intend to book in order to verify that you (and the other travelers for whom you are booking) meet the conditions specified by Background Paris in its advertisement, such as minimum age, skills, condition physical or otherwise. At your sole discretion, you may decide to inform Background Paris of any medical or physical problem, or other circumstances that could prevent you or any additional traveler from participating safely in any service.

Before and during a performance, you must always follow the instructions of Background Paris.

You cannot invite additional people to a service, if you have not added these people as additional participants during the booking process on the website www.background.paris



7 – TERMS OF PAYMENT

Online electronic payments are made on the www.background.paris site, which provides security using appropriate encryption and authentication technologies (SSL encryption).

Payment for orders is made by credit card. Only payment by credit card is accepted. The following cards are accepted: Carte Bleue, Visa, Euro Card, Mastercard. Payment by check is not accepted. We do not take responsibility for checks sent to us.

When registering the order, the buyer must pay 100% of the total amount of the invoice.

Background Paris is not responsible for any additional costs you may have incurred following the purchase of your trip, such as visas, vaccinations, non-refundable flights.

The security of your purchase is one of our main concerns. Tickets are purchased online, by payment by credit card. The security of the online payment tool and system is entirely ensured by our trusted third party, “Stripe”.

Background Paris does not have your credit card number on its servers at any time. The buyer’s bank details are not stored by the system.

Payment by card can use the 3D Secure system which aims to identify the card holder in order to limit fraud. Once the transaction has been validated by the bank, your bank account will be debited for the amount of the order.

 At the end of the transaction, an order confirmation will be sent to you by e-mail. You will be able to access all the essential characteristics of the selected experience and download an invoice from it. In case of a payment is invalidated by your bank, after the issuance of your ticket or your order, it will be invalidated, not allowing you access to the event.

It is then your responsibility to read the content of the message sent. Please note that some email providers may delay email delivery. In case of non reception after several hours, please contact us.

The purchase being final after full payment of the price, any rejection, for whatever reason, implies the abandonment of the purchase, which will therefore not be processed by Background Paris.

The user’s bank data will be kept only for the purposes of the current order.

The user acknowledges that the data recorded by Background Paris in the context of purchases made on the site www.background.paris constitute proof of all transactions made with the user and that the data recorded by the payment system electronic provided on the site constitute proof of financial transactions.

The final validation of your order implies acceptance of these general conditions of sale, fully and without reservation and can no longer be modified or canceled unless the right of withdrawal is exercised, in the event that this right is applicable.

It is forbidden to resell the services ordered on the site site www.background.paris or to use the site www.background.paris for commercial purposes without the prior, express and written authorization of Background Paris.

By definitively confirming his reservation on the site, the user acknowledges having fully understood the date or period of validity applicable to his purchase. Any ticket not used on the scheduled date or during the stipulated validity period will not be refundable.



8 – LATE PAYMENT + RESOLUTORY CLAUSE

In the event of total or partial failure to pay for the services delivered 30 days after the service, the buyer must pay Background Paris a late payment penalty equal to three times the legal interest rate.

The legal interest rate used is that in force on the day of delivery of the services.

This penalty is calculated on the amount including tax of the amount remaining due, and runs from the date of expiration of the price without any prior notice being necessary.

In addition to the compensation for delay, any sum, including the deposit, not paid on its due date will automatically result in the payment of a lump sum compensation of 40 euros due for collection costs.

Articles 441-6, I paragraph 12 and D. 441-5 of the Commercial Code.

Cancellation clause

If within fifteen days following the implementation of the “Late payment” clause, the buyer has not paid the sums remaining due, the sale will be automatically canceled and may give rise to the allocation of damages for the benefit of the company Background Paris.



9 – DELIVERY OF THE SERVICE

Delivery is made by direct delivery of the service to the buyer, on the day indicated, at the place indicated on the booking confirmation, received by the buyer after the payment.

The service provided to the participant is that appearing in the purchase confirmation email, in accordance with the content of the services as described on the site on the date of the order.

Any reasonable delay in the delivery of the services may not give rise to the benefit of the buyer for the allocation of damages or cancellation of the order.

The risk of transport is borne entirely by the buyer.



10 – DELAY

Late arrivals:

It is recommended to come at least 5 minutes before the scheduled start of the tour. Background Paris reserves the right to start the tour at the scheduled time and takes no responsibility for late arrivals. If you arrive after the service has started, you may have difficulties to catch up with the group and you may miss the service without being entitled to a refund or a new service.

Our services start on time. Any delay on the part of our customers will be deducted from the total duration of the service.

The guide has the right to cancel the tour and leave the meeting point if customers are more than 15 minutes late and do not answer our messages or calls. After 15 minutes, the visit will be automatically canceled and no refund will be made.

In case of delay, the participant may not be able to participate in the service, without this being a reason for postponing or reimbursing the service.

In the event that the latecomer is accepted, he will see the initial duration of his service reduced as much without this giving rise to a partial or total refund.

Any service interrupted or abbreviated or not consumed by the customer as a result and for any reason whatsoever, will not give rise to any refund.



11 – CASE OF FORCE MAJEURE

Means an event beyond the control of the co-contractor, which could not have been reasonably foreseen when the contract was concluded and whose effects cannot be avoided by appropriate measures, and which prevents the performance of its obligation by the co-contractor in application of article 1218 of the civil code.

If the weather conditions pose a risk to the safety of participants or prevent Background Paris from providing a proposed service which takes place mainly outdoor, Background Paris may cancel the proposed service. If the weather is impracticable on the day of the event, Background Paris undertakes to postpone the event to a later date.

Background Paris may also cancel the proposed service if there are other conditions which would prevent Background Paris from offering the proposed service safely.

The responsibility of Background Paris cannot be implemented if the non-execution or the delay in the execution of one of its obligations described in these general conditions of sale results from a case of force majeure.



12 – BOOKING MODIFICATIONS

You can modify your reservation until the confirmation of payment.

Except in cases of force majeure, (or the service will be postponed by us to a later date); Reservations can be rescheduled on a different date (subject to availability) up to 72 hours before the date of the visit. Without cancellation within the time limit, reimbursement or rescheduling will not be accepted.

When the deadline is less than 72 hours before the service, any modification to the reservation (for the choice of another date) will entail costs up to 25% of the amount. These costs are to be paid by bank transfer to Background Paris.



13 – CANCELLATION CONDITIONS – RIGHT OF WITHDRAWAL

Any cancellation on your part must be initiated by email at the following email address: contact@background.paris.

You may be eligible for a full refund depending on the number of days before the date of the service.

Users are responsible for all booking changes they make on the site www.background.paris and agree to pay all displayed prices, additional travel costs and / or all taxes associated with these booking changes.

Any order, once validated by secure payment, is considered firm and final.

The cancellation conditions for the services are as follows:

Cancellation more than 72 hours before the experience: free of charge.

Cancellation less than 72 hours before the experience: 100% fee

Cancellation on our part:

If Background Paris cannot perform the service due to force majeure, i.e. war, whether declared or not, civil war or any other armed conflict, military or non-military interference by one or more States third parties, rebellions or demonstrations, terrorist acts or serious threats of terrorist attacks, sabotage or piracy, strike or boycott, acts of governments or any other act of legal or illicit power, blockade, siege or sanction, or accidents, fires, explosions, plagues, or natural disasters such as, but not limited to, storm, cyclone, hurricane, earthquake, landslide, flood, drought, etc. or any similar event. Background Paris reserves the right to substitute the service for another of the same value.

In very rare cases, when the service is canceled by Background, for whatever reason that is our fault, you will be fully reimbursed.

In some cases, Background Paris may allow the user to apply the refund to a new reservation.

Background Paris reserves the right to cancel or modify an experience. In case of modification, the customer will be free to accept it or not. If he refuses it, the customer will be reimbursed without this giving rise to additional compensation.

In accordance with the applicable legal provisions, for distance contracts, the consumer customer who purchases a service, has 14 clear days to change their mind on their purchase, without having to justify it or pay penalties (excluding possible return costs). The customer must send a declaration, without ambiguity, expressing his will to retract. It is however expressly reminded that under the terms of article L121-21-8 of the Consumer Code, the buyer cannot exercise his right of withdrawal concerning the services of accommodation, transport, catering, leisure activities (shows) which must be provided on a specific date or periodicity. These will therefore not be subject to any reimbursement, said services being in any event designated as such to buyers, before the conclusion of the sale, in the description of the offer.



14 – SECURITY / PROHIBITED ACTIVITIES / DAMAGES AND DISPUTES BETWEEN PARTICIPANTS

For security and liability reasons, Background Paris has the right to refuse a client who is under the influence of alcohol or other substances, or behaves in a rude or threatening manner towards other guests or guides : a person whose condition would not be compatible with the attention imposed by the route of the service. No reimbursement or compensation may be requested in this regard.

It is your responsibility to comply with all laws, rules, regulations applicable to your use of the www.background.paris reservation site. In connection with your use, you do not allow yourself to help other people with, or allow other people to:

Violate or circumvent any applicable laws or regulations, agreements with third parties, rights of third parties, or our terms.

Use the site www.background.paris or collective content for commercial purposes or for other purposes which are not expressly authorized by these conditions, or in a manner which falsely suggests an approval by Background Paris , the existence of a partnership with Background Paris, or misleading in any other way as to your links with Background Paris.

Contact another member, recruit or solicit an artist to participate in third-party services, applications or websites without our prior written permission.

Use the site www.background.paris to request, make or accept a reservation made outside the site www.background.paris, to avoid service charges or for any other reason.

Request, accept or pay the price displayed outside the site www.background.paris or without going through Background Paris. If you do, you assume all risks and responsibilities relating to this payment, and release Background Paris from any responsibility for this payment.

Discriminate or harass anyone because of their ethnic or national origin, religion, sex, sexual identity, physical or mental handicap, state of health, marital status, age or sexual orientation, or engaging in any violent, dangerous, abusive or disruptive behavior.

Make improper or abusive use.

Use, display or copy the site www.background.paris, the name Background Paris, any brand, logo or other information that owns Background Paris.

16 – LIMITATIONS OF LIABILITY – EXCLUSION OF LIABILITY AND GUARANTEE

After the completion of a service, participants can leave a public comment and a star rating about their feelings after the delivery of the service.

The ratings and comments left by the participants must be faithful and must not contain abusive or defamatory terms.

Participants are prohibited from manipulating the rating and comment system in any way, for example by asking a third party to write a positive or negative comment.



20 – USE OF COOKIES

For any complaints or claims regarding copyright, you can send us an email at contact@background.paris. Our team will investigate and remove any content that violates these terms and conditions, or any ownership rights.

Any complaint relating to a service must be submitted to Background Paris within 72 hours of the end of the experience only by email. In the event of a persistent disagreement, the only competent jurisdiction is that of the Paris Commercial Court.

Before initiating an arbitration procedure, you and Background Paris each agree to notify the other party of the dispute, and to attempt to negotiate an informal resolution of the dispute first. We will contact you at the email address you provided to us. If, after we have tried in good faith to negotiate, one of us considers that the dispute has not and cannot be resolved informally, the party which intends to initiate an arbitration undertakes to inform it beforehand the other party by e-mail. To initiate an arbitration procedure, a complaint must be submitted.

These conditions of service do not confer and are not intended to confer rights or remedies on any person other than the parties.

The general conditions are subject to French law.
