1 – THE ORGANIZING COMPANY

Background Paris, self-employed, whose head office is located at 95 boulevard Soult 75012 Paris, registered in the Annecy Trade and Companies Register under the number 814 268 736 (hereinafter the Organizing Company), is organizing a game entitled ” Background Paris Contest – #capoupascap on the Background Paris Instagram account from May 27, 2020 to June 29, 2020 (hereinafter the “Game”), the conditions of which are indicated in these rules. Participation in this game is free and without obligation to purchase.

The Participant acknowledges being informed of the privacy policy of the Facebook / Instagram site which can be consulted directly on the Facebook / Instagram site.

This Game is not managed or sponsored by Facebook / Instagram. The personal data collected during the Game is intended for the organizing company. Facebook / Instagram cannot be held responsible in the event of a dispute related to the Game.

2 – PARTICIPATION

This Game is open to any adult physical person, residing in mainland France, with Internet access and a valid Instagram user account, associated with a valid e-mail address, with the exception of the staff of the organizing company, as well as any person involved in the organization, realization, implementation, promotion and animation of the Game.

The Organizing Company reserves the right to ask any participant to justify these conditions. Anyone who does not meet these conditions or refuses to justify them will be excluded from the Game.

The simple fact of participating in the Game implies the unconditional acceptance of these rules, in all their provisions, by the participant.

A user has the opportunity to participate and try his luck several times.

Participation in the Game is not limited to one story per person. The user can share as many stories as they want.

The Organizing Company also declares and guarantees that it has the copyright on the photograph (s) posted (s) either to be the author (photograph taken personally), or to have obtained the express agreement of the author of the photograph or of the persons identified on the photograph (s) so that the responsibility of the Organizing Company cannot be engaged due to the use of said photograph within the framework of this Game. photographs must not reveal any brand or any other intellectual property right support belonging to a third party.

In any event, to participate validly in the Game, the participant must strictly comply with the registration conditions as defined according to the case, on the online services of the Organizing Company and on those of its partners, as well as any other instructions communicated to it by any other means.

4 – ENDOWMENTS

The Game will designate from among all registered participations, 10 (ten) people respecting the conditions of participation.

Each winner will win a place for a Background Paris graffiti experience.

The value of each lot is € 150. This cannot be disputed regarding its evaluation. The prizes are neither exchangeable, nor replaceable, nor refundable, and cannot give rise to any monetary consideration, for any reason whatsoever.

Prizes that cannot be awarded due to an error, omission or change in the contact details provided by the winners will be kept by the organizing company.

5 – WINNER SELECTION PROCEDURES

The winners will be selected via a draw which will take place on June 29, 2020. The names of the 10 winners will be announced in the commentary on the photo contest on the Instagram page of Background Paris: https://www.instagram.com/background. paris /? hl = fr

The participants who will find out on the Background Paris Instagram account if they have won the prizes described in article 4 will be designated as winners. The winners will be invited from the publication in question to send by private message to the Instagram account of Background Paris their postal details, email addresses and contact phones, as well as confirmation of their acceptance of the lot.

Winners will have fifteen days from the announcement of the winners to confirm their acceptance of the prize and share their contact details. Any winner who has not replied within this period will be deemed to have renounced his prize altogether. At the end of this period, the unclaimed prize will be definitively lost.

Prizes may not give rise to any dispute of any kind, nor to the delivery of their equivalent value in cash, nor to any consideration of any kind.

The Organizing Company cannot be held responsible in the event of non-delivery of the publication announcing the gain, in the event of failure of the access provider, in the event of failure of the internet network or for any other case.

The Organizing Company reserves the right to replace any endowment by another equivalent endowment as to its value and characteristics, for any reason whatsoever without its liability being engaged in this regard

The Organizing Company reserves the right to ask any participant to justify the information communicated during their participation in the Game and in particular authorizes all checks on the identity or contact details of the participant. 6 – FRAUD

All participants must comply with these rules

The Organizing Company may cancel the participation (s) of any participant who has not complied with these Rules, and reserves the right to remove any fraudulent comments. This cancellation can be done at any time and without notice.

It is strictly prohibited, by any process whatsoever, to modify or attempt to modify the devices of the proposed Game, in particular in order to modify the results or any element determining the winners and the prizes awarded to them.

Any information that is inaccurate, misleading or does not meet the conditions for participation in the Game will result in the immediate elimination of the participant and, where applicable, the refund or return of the prize already sent, at the choice of the Organizing Company.

7 – ADVERTISING AND PROMOTION OF WINNERS

The Organizing Company reserves the right to use the names of the participants and winners without any consideration.

The participant authorizes, by participating in this Game, the Organizing Company to reproduce, represent, use and disseminate his story posted on Instagram.

The participant guarantees that he is not bound by an exclusive contract relating to the use of his name.

Each winner accepts in advance the use of his name, first name on any medium whatsoever, for the purposes of advertising or other communication, on the Internet or not, for a maximum period of 1 year without this use being able to give the right to another benefit than the prize won.

In the event that a winner does not wish to do so, he must stipulate this in writing in the message sent to the Background Paris team upon confirmation of acceptance of his winnings.

8 – LIMITATIONS OF LIABILITY

The organizing company cannot incur any liability if, in the event of force majeure or events beyond its control or justified necessity (for example, if the Game could not run smoothly due to a virus, a bug, intervention by an unauthorized third party, fraud, technical and / or postal problems), it was required to cancel this Game, shorten it, extend it, postpone it or modify it conditions.

The organizing company cannot be held responsible for any fact which is not attributable to it, in particular in the event of misdirection of mail, malfunction or interruption of communications or telephone lines, unavailability of the website, technical failure, malfunctions of the Internet network and more generally, the risks inherent in any connection and transmission, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible viruses circulating on the network.

It is up to each participant to take all appropriate measures to protect their own data and / or software stored on their IT equipment against any attack. The connection of any person to the site and participation in the Game is the sole responsibility of the participants.

The organizing company reserves the right to exclude from the Game and prosecute any person who has cheated or disturbed the smooth running of the Game

9 – DATA PROCESSING AND FREEDOMS

The information collected in the participation form is mandatory. They are intended for the organizing company with a view to participation in the Game, management of the winners and allocation of the prize. The data collected will also allow them to be informed about specific offers via a newsletter.

In accordance with the provisions of Law 78-17 “Information Technology and Liberties” of January 6, 1978, as amended, each participant has the right to access, modify, rectify and delete data concerning him. 10 – INTELLECTUAL AND INDUSTRIAL PROPERTIES

The reproduction, representation or exploitation of all or part of the elements making up the Game offered there is strictly prohibited. All brands or product names mentioned are brands or product names registered by their respective owners.

11 – CONSULTATION OF THE REGULATIONS

The rules are sent free of charge to any person who requests them before the end of the Game. The request is made by request on the “contact” section of the website www.background.paris

The Organizing Company reserves the right to modify these regulations, any modification will be available on the website www.background.paris

12 – DISPUTES

The simple fact of participating implies full acceptance of these rules.

Any modification of the rules will give rise to a new publication of the rules.

If one or more provisions of these Regulations were declared void or unenforceable, the other clauses would retain their full force and scope

These Regulations are subject to French law. Any dispute arising during the Game will be the subject of an attempt to reach an amicable settlement. In the absence of an agreement, the dispute will be submitted to the competent courts on which the head office of the Organizing Company depends, unless contrary to public policy.

No dispute will no longer be admissible one month after the close of the Game.
